Barsanti no. 29 (VAT no. 05099320284)\u2014hereby known as the Data Controller <\/strong>(email: info@kyroartgallery.com\u2013 Tel. 3341147775).<\/p>\n

Data processing purposes<\/strong> – The processing of personal data, executed in full compliance with current legislation (Legislative Decree No. 196 of 30 June 2003 and EU Regulation 679\/16), is carried out for the management of the relationship between the parties and to provide information regarding the professional activities of the undersigned Data Controller, for the purpose of communicating via electronic means and by telephone.<\/p>\n

Your personal contact details may also be processed for the purpose of sending you our newsletter, which contains information about our gallery\u2019s activities, including, for example, details of artworks, exhibitions and events.<\/p>\n

<\/p>\n

The undersigned Data Controller will therefore process your personal details (e.g. first name and surname, telephone number, email address) for the purposes set out above; these details are necessary in order to provide the services indicated above.<\/p>\n

Legal basis <\/strong>for the processing is therefore the implementation of pre-contractual or contractual measures and compliance with any legal obligations (Article 6(b) and (c) of the GDPR). In the event of a dispute, the legal basis is the legitimate interest of the Data Controller for the exercise of its right of defence (Article 6(f) of the GDPR).<\/p>\n

The legal basis for the processing of your personal data for the purpose of sending the newsletter is your consent (Article 6(1)(a) of the GDPR)<\/p>\n

Furthermore, in order to ensure the proper functioning of this website (and therefore in accordance with the Data Controller\u2019s legitimate interest in its operation pursuant to Article 6(f) of the GDPR), the IT systems and software procedures used to operate the site collect, during their normal operation, browsing data, the retention period of which is limited: they are deleted after processing and, in any case, within the timeframes set out in the cookie policy available on the website, which must be refered to.<\/p>\n

Methods of processing<\/strong> – The processing of personal data may involve the collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission or otherwise making available, alignment or combination, restriction, erasure or destruction of such data. Data processing will be carried out using electronic, IT and telecommunications tools designed to ensure the confidentiality of the data, in accordance with the provisions of current legislation.<\/p>\n

Personal data is processed in written form, on paper, magnetic media and electronically, using appropriate measures to ensure its security, and is stored in the data controller\u2019s database.<\/p>\n

The provision of personal data is not a legal requirement, but it is necessary \u2013 and must therefore be regarded as mandatory \u2013 so that the undersigned Data Controller can provide the requested information for the purposes set out above. If you refuse to provide this information, the Data Controller will be unable to carry out the requested task.<\/p>\n

Data controllers and recipients <\/strong>– The data is processed exclusively by the Data Controller or by persons appointed by the Data Controller who have received specific training in this area.<\/p>\n

The aforementioned personal identification data may be disclosed to all parties (recipients) who are authorised to access such data under current legislation and for purposes related to legal obligations (e.g. the Data Protection Authority, public authorities), as well as to parties appointed by the Data Controller to process the data. They may also be disclosed to persons responsible for processing operations related to the fulfilment of administrative, accounting and management obligations arising from the ordinary conduct of business, who may be appointed as Data Processors pursuant to Article 28 of EU Regulation 679\/16.  The list of data processors is available at the registered office of the undersigned Data Controller. Personal data will not be disclosed.<\/p>\n

<\/p>\n

Data location<\/strong> – Personal data is stored on servers located in Italy, and in any event within the European Union. It is understood, that the undersigned Data Controller will, where necessary, be entitled to relocate the servers outside the EU. In that case, it hereby gives an undertaking that the transfer of data outside the EU will take place in accordance with the applicable legal provisions and the requirements of Articles 44 et seq. of EU Regulation 679\/16.<\/p>\n

<\/p>\n

Rights of data subjects<\/strong> – In accordance with EU Regulation 679\/16, as a data subject, you may exercise the following rights:<\/p>\n

(a) the right to obtain confirmation from the Data Controller as to whether or not personal data concerning you are being processed and, where that is the case, to obtain access to the personal data and to the information referred to in Article 15 (e.g. information regarding the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the retention period, your rights, the origin of the data where not collected from the data subject, the existence of automated decision-making, etc.);<\/p>\n

(b) the right to have any inaccurate personal data concerning you rectified, and to have such data completed where it is deemed incomplete, always in relation to the purposes of the processing (Article 16);<\/p>\n

(c) the right to erasure of data (\u201cright to be forgotten\u201d), where one of the circumstances set out in Article 17 applies;<\/p>\n

(d) the right to restriction of processing, in the cases provided for in Article 18;<\/p>\n

(e) the right to data portability pursuant to Article 20;<\/p>\n

(f) the right to object to processing pursuant to Article 21;<\/p>\n

(g) where the legal basis for the processing is consent, the right to withdraw consent at any time without affecting the lawfulness of processing based on consent given prior to its withdrawal.<\/p>\n

<\/p>\n

The Data Controller does not use automated decision-making processes; the data subject is entitled to the rights set out in Article 22 of EU Regulation 679\/16.<\/p>\n

<\/p>\n

The data subject also has the right to be informed, where applicable, of the Controller\u2019s intention to transfer data to a third country or to an international organisation, and of the existence or absence of an adequacy decision by the Commission, or in the case of transfers pursuant to Articles 46, 47 and 49(2), the reference to appropriate and suitable safeguards and the means of obtaining a copy of such data or the place where it has been made available.<\/p>\n

<\/p>\n

All of the above rights may be exercised by submitting an informal request to the Data Controller (e.g. by contacting us by email or telephone).<\/p>\n

<\/p>\n

Finally, as a data subject, you have the right to lodge a complaint with a supervisory authority (Article 77 of EU Regulation 679\/16 \u2013 Article 140-bis et seq. of Legislative Decree 196\/2003).<\/p>\n

<\/p>\n

Retention period<\/strong> \u2013 Personal data will be retained only for the time strictly necessary to fulfil the purposes set out above and to comply with legal obligations (e.g. if the relationship is limited to the provision of information, until such information is provided and, in any event, until the purposes of the processing have been fulfilled).<\/p>\n

Your personal data will be processed for the purpose of sending the newsletter for a period of 24 months, unless you withdraw your consent beforehand (in which case you will no longer receive the newsletter) or renew your consent to extend this period.<\/p>\n

This is without prejudice to any legal disputes that may result in the retention periods set out above being extended.<\/p>\n

Subsequently, once the strictly necessary period has elapsed, personal data will be deleted or anonymised and used solely for statistical purposes.<\/p>\n
